Having a proper plan in place for a member of the GLBT community is essential to avoiding devastating consequences to his or her partner and family. An estate plan is critical, especially in the event of an accident or illness that renders the partner incapable of making decisions or managing his or her affairs. Without proper documents, such as an Advanced Health Care Directive or a Durable Power of Attorney, the other partner could be legally precluded from making any decisions regarding his or her partner’s care, managing his or her affairs, or even having access to the incapacitated partner.
